Terms of Service

These Terms of Service ("Terms") govern your use of BG Gaming's servers, website, and related services ("Service"). By accessing or using the Service, you agree to these Terms.

BG Gaming is a trading name of SCUDDER CONSULTANCY LTD, a company registered in England and Wales (company number 17288846), registered office 75 Newlyn Drive, Sale, England, M33 3LH ("we", "us", "our").

1. The service

BG Gaming operates a PvE cluster of modded ARK: Survival Ascended game servers, a Discord community, a promotional website, and an in-game shop. The Service is provided "as is" without warranty of uptime, persistence, or specific features.

2. Accounts

• You authenticate to our website using Discord OAuth. We read your Discord ID and username.
• To receive in-game perks you must link your EOS (Epic Online Services) character ID via our Discord bot.
• You are responsible for keeping your Discord account secure. We cannot recover perks granted to a compromised account.

3. Subscriptions

• Subscriptions renew monthly and are charged in advance via Stripe.
• Cancellation can be made any time via the website's "My Subscription" panel or the Stripe billing portal. Your perks continue until the end of the current period.
• We may change subscription pricing with at least 30 days' notice delivered to your Discord account.
• If a renewal payment fails, your subscriber perks are revoked immediately. You can restore them by updating your payment method and completing a successful charge.

4. One-off purchases

• Coin bundles and potion packs are digital goods delivered instantly to your in-game FusionShop balance / Redeem tab.
• Digital goods are non-refundable once delivered, except as required by law. See our Refund Policy for details.

5. Prohibited conduct

You agree not to:

• Use cheats, exploits, or third-party tools that modify game behaviour
• Harass, threaten, or discriminate against other players or staff
• Attempt to gain unauthorised access to our systems, APIs, or other users' accounts
• Resell or transfer subscriptions, perks, skins, or in-game items outside the intended channels
• Initiate fraudulent chargebacks — these will result in a permanent account ban and loss of all perks

6. Server availability

We aim for high uptime but do not guarantee uninterrupted access. Maintenance, updates, or unexpected outages may make the Service temporarily unavailable. No refunds are issued for short outages. Extended outages may be credited at our discretion.

7. Wipe policy

We do not wipe servers. If we ever change this policy, we will announce it with at least 60 days' notice.

8. Termination

We may suspend or terminate your access (including active subscriptions) if you breach these Terms. In such cases no refund is due, though we will deliver any previously-paid perks for the remainder of the current billing period where reasonable.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance. Material changes will be announced in our Discord.

10. Governing law

These Terms are governed by the laws of England and Wales.
